Working as part of the client’s team, we carried out a comprehensive gap analysis of existing works data, identified a pathway to compliance via the BSR, and advised on appointing the necessary specialist engineering disciplines.

Value add: Our technical knowledge and advice assisted the client to discharge their duty holder responsibilities as BRPD and enabled the technical team to demonstrate the necessary steps to achieve compliance with Building Regulations and secure buy-in from their Board to undertake same.

Role: We prepared remedial proposals for the replacement of defective cladding to an existing building in Liverpool. Our role included:

  • Investigating and opening up the external wall system to identify defects.
  • Producing an Employer’s Requirements Document (ERD) for removing the defective cladding and installing a new compliant system.
  • Managing the project and liaising with the owner, developer, and tenants, acting as Project Manager and Employer’s Agent.
  • Completing a scan survey and preparing existing drawings and indicative wall construction details for pricing within the ERD.
  • Developing indicative remedial designs and coordinating all specialist inputs, including structural, fire engineering, and manufacturer details.

Value add: Establish scope of works including reviewing and inspecting the affected area to determine an appropriate remedial repair strategy. This will involve considering the building’s classification as a Higher-Risk Building (HRB), reviewing relevant documentation such as FRAEW and FRA reports, and assessing the implications of Building Safety Regulator (BSR) requirements, including any necessary regularisation and compliance applications, considering the necessity of emergency repairs approach. Where compliance issues are identified, we will coordinate and manage a multi-disciplinary team to resolve these matters and deliver effective solutions. Additionally, we will provide advice on the impact of The Higher-Risk Buildings (Descriptions and Supplementary Provisions) Regulations 2023 and how these regulations influence the approach to remedial works. For example, if the affected area is an independent section (such as a GF commercial unit with separate access and egress, not shared with apartment access), it may be possible to undertake remedial works under standard building regulations rather than through the BSR process. This advice will be made on a case-by-case basis following a detailed assessment of the specific circumstances.

Value add: Our team in the limited timescale of adjudication was able to significantly reduce our client’s losses. Our delay and quantum reports helped to defend the claim, with the EOT awarded reduced to 197 days and loss awarded to £8.3m.
