Land & compensation
Major infrastructure projects can mean major challenges. Our team is here to help you overcome these challenges to maximise development opportunities while minimising risk.
What do we do?
With a team dedicated to supporting infrastructure development schemes, we have the experience and expertise to support infrastructure projects at every stage, significantly increasing the chances of promoters securing consent and implementing powers in a manner that reduces cost and risk at every stage of the process.
Services that we can provide include:
- compulsory purchase advice for acquiring authorities and property owners
- securing access to land for surveys
- drafting land acquisition strategies
- property cost estimates
- early acquisition agreements
- landowner consultation
- GIS mapping
- drafting the Book of Reference and Land Plans
- expert witness support at hearings/ inquiries
- dispute resolution
- preparation and service of notices
- compensation negotiation
- alternative dispute resolution and Upper Tribunal support.
We have vast experience of the Planning Act 2008 and have worked on over 30 Nationally Significant Infrastructure Projects (NSIPs). This means we can support our clients’ major infrastructure projects from inception to completion, advising on all land-related issues that arise along the way.
The team has extensive experience of negotiating option agreements to support the promotion of infrastructure projects and regeneration schemes, primarily under the shadow of compulsory acquisition. Securing such agreements eliminates consenting and delivery risks from the infrastructure development of these projects.
Compulsory purchase
Our compulsory purchase surveyors are market leaders in advising on Compulsory Purchase Orders (sometimes shortened to CPOs). We regularly advise scheme promoters (i.e. acquiring authorities or developers) on the promotion and implementation of Compulsory Purchase Orders, valuing and assessing compensation entitlement, and assembling land by agreement. We advise acquiring authorities and developers on Compulsory Purchase Orders for housing and regeneration projects, Transport and Works Act Orders, Highway Orders and Development Consent Orders throughout the UK. At each stage of a scheme we help our clients to deliver schemes, whilst creating significant cost savings and minimising risks.
Our compulsory purchase surveyors also advise affected property owners and occupiers from initial consultation through to settlement of compensation claims to make sure the impact of compulsory purchase is minimised and to negotiate fair compensation in line with the statutory compensation code.
Whether you are an acquiring authority or developer looking to implement a Compulsory Purchase Order, or a property owner who is threatened by compulsory purchase, our compulsory purchase surveyors are able to provide support on all aspects of the process.
The plans for each Housing Zone have advanced considerably ... I have no hesitation in commending their work and the contribution of the lead consultant Malcolm Newman at Gateley [Built Environment] and recommend them for similar commissions.
